Hoy fue la audiencia entre sm y los tres miembros...
Primero que todos, mis pensamientos han sido puestos aquí asi que por favor tomen eso en consideración mientras lo lee. Lo debí haber escrito cosas abajo mientras estaba allí T_T...
No recuerdo todo... pero escribiré todo lo que recuerde aquí.
Cuando fui, habian un par de reporteros y ... el presidente Kim young Min asi como una mujer, y ese mujer se amntenía suspirando... como alguien que era inocente y que era tratada de manera injusta, especialmente cuando el abogado de los tres miebmros estaba hablando...
(Ahora ser que, esa mujer es la Presidenta de SM Japón)
Hablaré acerca de lo que se estaba hablando entre nuestras estrellas (Cassiopeia) primero. Ustedes tienen que saber esto.
Veo a muchas de nuestras estrellas diciendo que los tres meimbros deben aceptar las condiciones de hoy, pero recuerden que SM no fueron loq eu pusieron estas condiciones!!!

La idea vino del juez casi al final de la audiencia,
El jues le dió al representante de SM un ejemplo muy extremista y le preguntó si SM estaría dispuesto a cambiar el contrato de lso tres miembros si los terminos fueran de una duración de un año y si el contrato fuera totalmente difernte del actual,
El representante de SM dijo al juez para preguntar eso a Kim Young Min,
Kim young Min se puso de pie (para mí, lucía un poco vacilante) y dijo, "Estariamos dispuestos a llegar a un acuerdo."
Se siente como que estaba diciendo que estarian dispuestos a considerarlo pero no que estarian de acuerdo en un arreglo de seguro.
A esto, el juez preguntó la parte de los tres meimbros la misma pregunta, y el abogado habló como si no tuviera inclinación a llegar a un acuerdo.
Parecía como si estuviera viendo lo que decía ya que los tres miembros no estaban allí, pero dijo que los tres miembros realmente no querian llegar a un acuerdo...
Asi que el juez preguntó si un acuerdo era imposible y el abogado de los tres miembros dijo algo acerca de la confianza personal y que a relación entre los tres miembros y SM se habia vuelto demasiada apretada.
Y sobretodo...esto fue un poco... pero personalmente, pensé que el abogado de SM habló muy bien. Casi sentí que estaba siendo persuadida?
Lo que dijo sonó tan creible... pero era un poco arrogante? Se sentó curvado en su silla, y sentí que la manera que habló fue un poco arrogante.
Comparado a él, el abogado de los tres meimbros era... tan carente que yo quería hablar en vez de él.
El juez estaba como lanzandoles preguntas de una manera atacante y fue capaz de recoger todas las fallas en los argumentos.
Y dijo que los dos fuera de los tres miembros tenian lineas de creditos (*por favor vean abajo) y le preguntaron a SM como ellos hiban a explicar eso.
+) El juez dijo a la parte de SM, "Ustedes dijeron que los dos de los tres meimbros tenian lineas de creditos, cierto?" Sm trató de decir, "no, uno..." pero el abogado de lo tres miembros cortó y dijo, "Son dos."
Y lo de Crebeau no fue planteado.
La parte de SM declaró que SM balancea cuentas dos veces al año. La parte de los tres miembros declaró que todo esto pasó parcialmente debido al hecho de que los salarios de los tres miembros para la primera mitad del 2009 no fueron correctos, asi que SM les dijo que vayan a ver ellos mismos.
La información para los conciertos y actividades no fueron clasificados en TVXQ, Super Junior, SNSD, etc, si no venian todos juntos en los grupo de 200X, mesX, díaX asi que SM dijo que toda la información habian tenido que almacenarlo en un contenedor.

El representante de SM declaró que los tres miembros mismos sabrian mejor en donde performaron asi que deberian venir personalmente...
De todos modos, ellos aún no han sid capaces para comprobar correctamente esto ya que no hubo una respuesta.

También, el abogado de los tres miembros dijo que recibió una copia de las cuentas pero los detalles de donde venian no fueron escritos en ellos.
Por ejemplo, se dijo que TVXQ ganó 3.4 billones de won de los conciertos de su primer asia Tour que tuvo un total de 14 presentaciones, pero en su segundo Asia tour, que tuvo un número similar de audiencia y un par de presentaciones extras, ellos ganaron 1.5 billones de won menos (No recuerdo si dijo que fue 1.5 billones de won menos o que fue 1.5 billones en total).
Por lo tanto, dijo que no podía confiar en SM,
y por las actividades Japonesas, TVXQ ganó más de 99 billones de won pero el dinero nunca llega a ellos, y que su ganacia japonesa son dividida entre AVEX y SM Japón, y luego a SM y luego a los miembros.

Si pudiera decir una cosa más, creo que SM tiene mucha evidencia preparada para este juicio. cada vez que el representante abria la boca, decía que presentaría todo luego....
Cuando las personas estuvieron dejando la audiencia... salí cuando Kim Young Min estaba llendose... y casi juro... él estaba sonriendo mientras estaba saliendo y tenia... una expreción de confianza en su rostro... personalmente pienso que el juez estaba inclinandose por el lado de SM...(ese es un pensamiento personal)
De todos modos, el abogado era muy convincente... Me molesté tantp, quería levantarme y hablar por los tres meimbros...decian cosas ridículas... como dije, añdiré más cuando lo recuerde.

Cerca al final, cuando estaban hablando acerca d euna arreglo, el juez pidio para que los tres miembros dijeran algo ellos mismo,
pero el abogado de los tres miembros dijo que no habia pasado mucho desde que los tres miembros no eran menores de edad y que ellos podrian no ser capaces de hablar bien en tal situación. El abogado de SM se burló y dijo, "Ellos ya no más son niños, lo son?"... su voz derrabama burla... (desde un prunto de vista personal)
Honestamente, los tres miembros nunca han esta en un ambiente así, entonces es cierto que ellos podrian no haber sido capaces de hablar bien,
Creo que fue por eso que el abogado dijo tales cosas... um...

Y lo que la parte de los tres miembros estaba enfatizando era las actividades de presentaciones como cinco.

First of all,
my personal thoughts have been put into this so please take that into consideration as you read it. I should have written stuff down while I was there T_T...
I don't remember everything... but I will write everything I remember here.
When I went, there were a couple of reporters and... President Kim Young Min as well as some woman, and that woman kept sighing... like someone who was innocent and being unfairly treated... throughout the whole trial, especially when the three members' lawyer was talking...
(I know now that, that woman is the President of SM Japan)
I'll talk about what is being talked about between our stars (Cassiopeia) first. You have to know this.
I see a lot of our stars saying that the three members should agree to the conditions laid out today,
but remember that SM was not the ones to put forth those conditions!!!

The idea came from the judge near the end of the hearing,
The judge gave SM's representative a very extreme example and asked him if SM would be willing to change the three members' contract if the terms of contract were a year long and if the contract was entirely different from the current one.
SM's representative told the judge to ask that to Kim Young Min,
Kim Young Min stood up (to me, he looked kind of hesitant) and said, "We would be willing to come to a settlement."
It felt like he was saying that they would be willing to consider but not that they would agree on a settlement for sure.
To this, the judge asked the three members' side the same question, and the lawyer talked as if he had no inclination to come to a settlement.
It did seem as though he was watching what he said as the three members weren't there, but he said that the three members didn't really want to come to a settlement..
So the judge asked if a settlement was impossible and the three members' lawyer said something about personal trust and that the relationship between the three members and SM had become too tight.
And overall... this was a bit.. iffy.. but personally, I thought SM's lawyer spoke very well. I almost felt as though I was being persuaded?
What he said sounded so credible... but he was a bit arrogant? He sat crooked in his chair, and I felt that the way he spoke was a little arrogant too.
Compared to him, the three members' lawyer was... so lacking that I wanted to speak instead of him.
The judge was kind of throwing questions at them in a kind of attacking way and was able to pick out all the flaws in the arguments.
And he said that two out of the three members had credit lines (*please see below) and asked SM how they were going to explain that.
+)The judge said to SM's side, "You said that two of the three members have credit lines, right?" SM tried to say, "No, one..." but the three members' lawyer cut in and said, "It's two."
And Crebeau wasn't brought up that much.
SM's side stated that SM balances accounts biannually. The three members' side stated that this all happened partially due to the fact that the members' wages for the first half of 2009 weren't right, so SM had told them to come check for themselves.
The information for concerts and activities aren't sorted into TVXQ, Super Junior, SNSD, etc, but it comes all together in the groups of 200X, month X, day X so SM said all the information they had could store a container truck.
They said that was why they did not submit the documents to the Courts, and they told the three members to come check for themselves, but a representative of the three members came instead. So the judge asked SM why the three members had to come, and why the representative simply couldn't have been given the files to give to the three members. SM's representative stated that the members themselves would know best of what they performed in so they should personally come...
Anyway, they still haven't been able to properly check this as there wasn't an answer.
(Sorry... I don't remember a lot of this part...)
Also, the three members' lawyer said that he received a copy of the accounts but the specifics of what came from where were not written on them.
For example, it said that TVXQ earned 3.4 billion Won from their first Asia tour concerts that had a total of 14 performances but in their second Asia tour, that had a similar number of audience members and a couple of extra performances, they earned 1.5 billion Won less (I don't remember if he said that it was 1.5 billion Won less, or that it was only 1.5 billion total).Therefore, he said that he couldn't trust SM,

If I could say one more thing, I think SM has a lot of evidence prepared for this lawsuit. Every time the representative opened his mouth, he would say that he would submit it all later........
When people were leaving after the hearing... I went out when Kim Young Min was leaving.... and I almost swore.... he was smiling as he was walking out and he had such a... confident expression on his face.... I personally thought the judge was leaning towards SM's side.. (that's a personal thought)
Anyway, the lawyer was very convincing... I would get so angry, I wanted to get up and speak for the three members instead.. they would say ridiculous things..... as I said, I'll add more when I remember it.
